EB-5 investment in Texas: eligibility and risk

EB-5 is a federal immigration category. A Texas project must satisfy the same federal eligibility and evidence rules as a project elsewhere in the United States. Its location does not create a guaranteed Green Card, a faster queue or a safe investment.

Investment and job creation

For current filings, the standard capital requirement is $1,050,000, reduced to $800,000 for a qualifying targeted employment area or infrastructure project. These are investment amounts, not the total application budget. Government, legal, administrative and due-diligence costs may be additional. Statutory inflation adjustments begin in 2027; confirm the amount applicable when filing. See the EB-5 statute.

The USCIS program overview requires the qualifying investment and at least ten qualifying full-time U.S. jobs, subject to the applicable creation or preservation rules. A spouse and unmarried children under 21 may be eligible as derivatives; age-protection and timing issues require individual review.

Standalone and regional-center cases

A standalone case and a regional-center case differ in their structure, job-counting evidence and filings. A regional center’s USCIS designation is not a government endorsement of the investment’s quality. Review the specific enterprise, project documents, financing and job methodology.

Prepare a traceable record of the lawful source and path of funds. Gifts, loans, company distributions and property-sale proceeds can require different supporting records. Resolve gaps before transferring capital.

Review the Texas project on its own merits

  • Business evidence: development permissions, budgets, financing commitments, market assumptions and construction or operating progress.
  • Investor terms: fees, conflicts, related parties, distribution rights, redemption restrictions and loss exposure.
  • Immigration evidence: qualifying location, job allocation, filing history and ongoing reporting.
  • Exit assumptions: distinguish a projected repayment date from an enforceable obligation and from immigration sustainment requirements.

The joint SEC/USCIS investor alert warns against guaranteed immigration results and investment claims. Capital can be lost, and immigration compliance does not guarantee repayment. Independent financial and securities review should complement immigration advice.

From petition to removal of conditions

The process can involve the investor petition, consular processing or an eligible adjustment-of-status application, conditional permanent residence and a later petition to remove conditions. Filing an investor petition alone does not grant permission to remain or work in the United States. Visa availability and individual status affect the next step.

Do not wait until a conditional card has expired to investigate removal of conditions. Plan that filing and the investment/job evidence with counsel in advance. There is no single end-to-end approval or repayment timeline for all EB-5 investors.

Where can my family live?

Permanent residence is a U.S. status rather than Texas-only permission. Nevertheless, the investor’s required role in the enterprise, continuing residence obligations and household tax position should be assessed before choosing where to live.
