Service of Process in Brazil

The appropriate procedure depends on the country where the case is pending, the documents involved and the recipient’s address. A Hague Service Convention request and a letter rogatory should not be treated as interchangeable instructions. Understanding Cross-Border Service

Service gives the recipient formal notice of proceedings and an opportunity to respond. Serving documents in Brazil for a case pending abroad is different from starting a domestic Brazilian lawsuit. The originating court’s requirements and the applicable international and Brazilian rules must be considered together.

The Hague Service Convention Route

Brazil is a party to the Hague Service Convention, which concerns service abroad in civil or commercial matters. Whether it applies must be assessed for the particular request. The Convention does not apply where the recipient’s address is unknown.

1. Review the Request and Forwarding Authority

Under Article 3, an authority or judicial officer competent under the law of the originating State forwards the prescribed request to the receiving State’s Central Authority. This is not a universal requirement to hire someone in Brazil to file it. We can assist foreign counsel with reviewing the proposed route and preparing the Brazilian aspects of the request.

2. Prepare the Documents and Portuguese Translations

Brazil’s designated Central Authority is the Ministry of Justice and Public Security. Its published requirements call for Portuguese translations of documents transmitted for service and of the completed blanks in the mandatory form, subject to the exception for the form’s standard terms. We review the required documents and the applicable translation formalities before submission.

3. Follow Execution and the Certificate

Brazil’s published guidance states that service is carried out through its judicial system. Under Article 6, the certificate records how service was completed or why it could not be effected. We can help review the returned information and discuss next steps if the request encounters an obstacle.

Letters Rogatory and Other Applicable Routes

The appropriate treaty or procedural route must be assessed separately. Letters rogatory involve a request for judicial cooperation; their requirements and any role of the Superior Court of Justice (STJ) must be examined for the particular matter. An unsuccessful service attempt does not automatically make a different route available or appropriate.

Timing and Delivery Restrictions

Timing varies with the request, the address, any need for corrections and the authorities handling execution. The HCCH Brazil practical-information profile, last updated in July 2022, gives a usual execution range of nine to eighteen months. That published range is background information, not a current case-specific estimate or a deadline we can promise.

Brazil has objected to the Article 10 transmission channels. Do not assume that direct international mail or a private delivery arranged outside the applicable procedure will constitute valid service. Any proposed alternative should be reviewed against the applicable rules and the originating court’s requirements.
