Finding Bank Accounts and Estate Assets in Brazil

How to Locate Bank Accounts or Hidden Assets the Deceased May Have Had in Brazil Locate Bank Accounts or Hidden Assets

Dealing with the estate of a loved one can feel daunting, especially when you suspect there may be assets or accounts you have yet to discover.

In Brazil, several legal procedures and tools can help you find hidden property or funds. Having an attorney on your side can help clarify the available routes. An experienced lawyer knows how to request searches, verify records, and handle formalities that might otherwise cause confusion or delay. This approach is key if you are preparing for lawsuits or anticipate disputes related to inheritance or other rights.

This guide explains how to identify estate assets, who can request protected records, and what search results can establish. An undiscovered asset is not necessarily a concealed asset. For administration and distribution, see our Inheritance & Probate services.

Start with your authority and the available records

Gather the death certificate, the deceased’s full name and CPF, your identification, proof of your relationship or appointment as estate representative, any probate case number, and the records you already hold lawfully. Depending on the request, counsel may need a power of attorney with specific powers to obtain confidential information.

Finding an account is different from receiving its money. A search result does not authorize a withdrawal, establish your inheritance share, or remove the need for the applicable estate procedure. Do not use the deceased’s login or present yourself as the account holder.

Three steps, three different results

1. Find a lead

A bank relationship, property reference or declared asset points to a source to investigate.

2. Verify the record

Obtain the relevant balance, title or supporting document through an authorized route.

3. Address it in the estate

Determine ownership and the appropriate probate, recovery or distribution step.

A match is a lead, not proof that an asset belongs entirely to the estate or can be transferred immediately.

Role of the Attorney

Search for real estate

Locating real estate in Brazil often involves requests to property registries in different states, because real estate registration is highly decentralized. An attorney can file formal requests with land registry offices, known as “Cartórios de Registro de Imóveis,” to check if the deceased had any property. A search can also be made at Registro de Imóveis to find the relevant registry data in each region.

Request searches for bank accounts

Brazilian financial privacy laws are strict. However, a court order is not required for every search. The Central Bank provides a documented request route for eligible heirs or estate representatives to obtain confidential reports about a deceased person. Applicants must establish their status; an agent needs the required specific authority.

The Central Bank’s requester-facing Contas e Relacionamentos (CCS) report identifies financial institutions and relationship dates. It does not show account numbers, balances or transaction histories. Counsel can use those leads to identify which institutions require follow-up.

An attorney can assist by filing a formal petition with a judge, who can authorize access to statements or account information where the requirements are met. Sisbajud is a judicial system, not a public search tool or a database a lawyer can access simply by being retained. This step helps clarify how many bank accounts existed and whether they still hold funds.

Request searches for tax returns

Tax returns can show previously unidentified sources of income or disclosed property. A lawyer may petition for the deceased’s tax records, known as “Declarações de Imposto de Renda,” to see if there is evidence of hidden assets. This request must go through Brazilian tax authorities, often requiring death certificates and legal documents establishing your right to request this information.

Tax secrecy does not mean a court order is always necessary. Receita Federal has procedures for authorized representatives to access a deceased taxpayer’s digital services. The correct representative and supporting documents depend on whether probate is pending or complete. A return is a lead: it may be incomplete, outdated or show a value different from current market value.

Actions You Can Take Yourself

Possibility of searching for real estate. You have the option to consult public property records yourself, but keep in mind that results are scattered across different registries. If you are missing legal documents, the process can become overwhelming.

Possibility of searching for wills. The official will-search service provides a route to request the relevant certificate. You may start this on your own, but an attorney’s assistance can save you time. Experts will know what forms to file or how to handle negative results.

For bank and tax records, first confirm your authority. An eligible heir or representative may be able to use an administrative route; other requests may require action by the estate representative or a court. Bank accounts and tax data are protected by privacy laws. If you attempt to obtain them without the required authority and documents, you risk delays or outright refusals.

Check the Central Bank’s unclaimed-values service

The Sistema de Valores a Receber (SVR) can identify certain amounts institutions report as available for return. Eligible heirs, executors, estate representatives or legal representatives use their own authorized access for deceased-person inquiries. The institution explains the documents needed to request payment.

SVR is not a complete account search. A negative result does not establish that there are no bank accounts or estate assets. Use the Central Bank’s official service; it is free.

Searching for Real Estate in Brazil

Accessing property information is easier if you know the state or municipality where the deceased lived or held land. After gathering personal data, you or your lawyer can consult available Registro de Imóveis services for leads on ownership. If you suspect property was hidden, your attorney may expand the search to different states.

Each property registry keeps precise details about transfers, liens, and ownership changes. Lawyers will cross-reference that data with other findings. This helps identify gaps and inconsistencies; it cannot guarantee that every asset will be found. Locating hidden real estate can be crucial for disputes or lawsuits that involve dividing property among heirs.

RI Digital’s preliminary CPF/CNPJ search may return a property reference associated with an owner, former owner or someone with another relationship to the property. A positive match does not prove current ownership. Request the appropriate registry certificate and, where needed, a qualified search. Older records, incomplete indexing and the registries covered by the request can affect results.

Searching for Wills in Brazil

Tracking down a will is one of the first tasks. Lawyers can request searches through official channels and online resources. CENSEC’s will-search records concern public wills and instruments approving closed wills reported by notaries. The certificate’s coverage and any local requirements need to be checked.

A will can dramatically change how an estate is handled. By searching through the official will-search service or relevant notary offices, you may locate a record leading to instructions left by the deceased. This process can also help prevent conflicts that might arise if a relative comes forward with a testament nobody knew existed.

An attorney can organize the correct documents, contact relevant offices, and assess the steps needed to present the will to the competent authority. That review is particularly important if an inheritance dispute is anticipated in Brazil.

A negative certificate is not proof that no will exists anywhere. A private or foreign will may require separate inquiries. For the certificate and document service, use our Search for Wills in Brazil page.

What if an asset was omitted or deliberately concealed?

First establish what the record shows and whether the asset belongs to the estate. An overlooked account or a disputed ownership entry is not automatically evidence of fraud. Where deliberate concealment or a contested entitlement is supported by evidence, see our inheritance disputes and estate litigation page.

An asset discovered after the estate was divided may require a supplemental partition (sobrepartilha). The correct route depends on the asset, the earlier proceeding and whether rights are disputed. Do not postpone urgent procedural or tax advice while searches continue: consult the probate process guide and tax and fees guide.

How we organize an estate-asset search

A senior bilingual attorney can help define the search scope, identify the authority needed for confidential requests, and explain the results in plain English. We agree the work and fees before proceeding. Registry charges, translations and any court work depend on the agreed scope.

Our approach

Define

Review your status, known assets, locations and the questions that need answers.

Search and verify

Use appropriate official channels and follow up on meaningful matches.

Explain next steps

Report findings, coverage limits and any further records or estate action needed.

We do not promise an exhaustive search, a particular recovery or a fixed completion time for third-party responses.

Start with the records you already have. In an initial consultation, we can assess the practical search scope and whether administrative requests, registry work or a judicial application may be appropriate. For non-estate investigations, see our broader Asset Search in Brazil service.
