Inheritance Tax and Probate Fees in Brazil: A Guide for Foreign Heirs

Inheritance tax and probate in Brazil for foreign heirs

An inheritance in Brazil can involve state inheritance tax, legal fees, document expenses and registration costs. If assets are sold or money is sent abroad, further costs may arise. A useful estimate separates these items and shows when each may need to be funded.

ITCMD is Brazil’s state inheritance and gift tax. The Federal District also levies it. Its national rate ceiling is currently 8%; that is neither a universal rate nor a cap on the total cost of an inheritance. Senate Resolution 9/1992 — rate ceiling

This guide explains the tax and cost questions foreign heirs should resolve. For the broader legal process, see our Inheritance & Probate services.

What determines the inheritance tax?

The calculation starts with the relevant jurisdiction, the assets and rights being transferred, the beneficiary’s taxable share, and the law applicable to the death. A current website rate alone cannot establish the tax for an older estate.

Complementary Law 227/2026 provides national ITCMD rules, including progressive rates and market-value taxation. State legislation and applicable effective dates still need to be checked. For Brazilian real estate, the property’s location generally identifies the taxing state. Movable assets and cross-border situations use different connecting rules, including domicile. Prepare the death certificate, the deceased’s last domicile, the beneficiaries’ domiciles, and an asset list with locations and ownership percentages. These facts let counsel identify which tax authority or authorities must be considered.

Budgeting example: tax is only one line item

Illustration only: assume a beneficiary has an established taxable share of R$500,000 and the applicable rate is 4%, with no exemption, deduction, penalty or interest. The arithmetic is R$500,000 × 4% = R$20,000. This is not a determination of the rate or taxable base for your estate. For context, São Paulo’s current calculation guidance uses 4%, but that does not make it a nationwide rate. São Paulo — declaration and calculation

Budget item What to confirm
Inheritance tax The jurisdiction, taxable base, rate or brackets, exemptions, deadline and any additions.
Professional fees The agreed scope: probate, tax assistance, disputes, registration, sale and remittance may be separate work.
Court or notary charges The chosen procedure and applicable local fee schedule.
Property and other registrations Each registry or institution needed to record the resulting ownership.
Documents and valuation Certificates, apostilles or legalization, sworn translations, searches and any required appraisal.
Sale or international transfer Any later sale expenses, applicable taxes, exchange rate and provider charges.

Ask for a written estimate that distinguishes confirmed charges from provisional allowances. Identify who will pay each item, when payment may be needed, and whether funds are accessible before the estate’s assets are released.

Which property value should be used?

Do not assume that the amount on an old income-tax return, an IPTU bill or a family agreement is automatically the correct inheritance-tax base. São Paulo’s published guidance, for example, distinguishes market value from municipal property-tax references. São Paulo — property valuation, tax-return ruling 15476/2017

Tax assessment, fair division between heirs and a possible sale can require different valuation evidence. Our guide to property appraisals in Brazilian probate explains those distinctions, including how to respond when a value appears too high or too low.

When must probate start, and when is tax payable?

These are separate questions. Article 611 of the Code of Civil Procedure sets a two-month period for initiating the probate and partition proceeding, subject to judicial extension. It should not be rewritten as one universal 60-day tax-payment deadline. Code of Civil Procedure — art. 611

State rules govern tax filing, payment and additions for delay. São Paulo’s guidance illustrates that payment timing can involve a separate 180-day reference and other procedural conditions. Do not apply that timetable to another state without checking its rules. São Paulo — payment deadlines

The route also matters. CNJ Resolution 695/2026 removed proof of prior ITCMD payment as a condition for drawing up a notarial probate and partition deed. It requires an express acknowledgment of tax obligations and notification to the tax authority when payment has not occurred. CNJ Resolution 695/2026 — notarial deed and ITCMD

This does not erase the tax or suspend state deadlines. São Paulo expressly states that the notarial change is not a tax exemption or its authorization to leave the tax unpaid. Counsel should confirm the tax position and the requirements for subsequent registration or release of assets. São Paulo — deed without prior ITCMD payment: tax-authority notice

For the judicial procedure called arrolamento sumário, STJ Tema 1074 also distinguishes approval of the partition and issuance of the relevant documents from prior ITCMD payment; other taxes on estate assets and income remain relevant. This is not a rule for every form of probate. STJ Tema 1074 — arrolamento sumário and prior payment

Start with a deadline and funding assessment, even if documents are incomplete or heirs disagree. See the probate process guide for the procedural stages.

Does receiving an inheritance also trigger income tax?

Receipt of an inheritance and a taxable capital gain are different events. Brazilian income-tax guidance treats inherited assets as a distinct reporting category; the transfer can nevertheless produce a taxable gain for the estate if the chosen transfer value exceeds the relevant declared cost. A later sale raises another gain calculation. Receita Federal — reporting inheritances and other receipts · Receita Federal — transfers subject to capital-gains tax

Before choosing values or signing a distribution agreement, coordinate the state inheritance-tax calculation with the estate’s federal income-tax filings and the heir’s future cost basis. A figure valid for one purpose does not automatically settle the other.

What should heirs living in the United States check?

Living in the United States does not, by itself, establish that the deceased’s estate owes U.S. federal estate tax. That analysis depends on the deceased’s citizenship or domicile, asset location, applicable thresholds and other estate facts. Any available credit or relief also requires its own review. IRS — estate-tax FAQs

Your obligations as a recipient are a separate question. A qualifying bequest from a foreign estate may require Form 3520 reporting when the applicable threshold is exceeded. Foreign accounts and financial assets can also raise FBAR or Form 8938 requirements; those forms have different rules. IRS — gifts and bequests from foreign persons · IRS — Form 8938 and separate FBAR requirements

Give your U.S. adviser the estate documents, values, dates, taxes paid and details of any accounts or assets you retain. Ask separately about the inheritance receipt, later rental or investment income, and a future sale. Do not assume that a Brazilian tax payment completes your U.S. reporting.

Can the tax or total cost be reduced lawfully?

Before paying, check whether the declaration correctly identifies the transferred interest and whether an applicable exemption, deduction, relief or payment arrangement is available. Verify supporting evidence and deadlines. An estate that has already opened may still need corrections or a justified valuation challenge.

An unequal distribution can raise an additional transfer question. São Paulo’s guidance treats certain excess allocations as gifts; a family agreement should therefore be reviewed before it is signed, rather than assuming that the original inheritance-tax payment covers every later arrangement. São Paulo — inheritance and excess allocation

Lifetime gifts and ownership structures require a separate analysis. They do not offer automatic tax savings. For assets still owned by a living client, see lifetime estate planning.

Does ITCMD also apply to gifts made during life?

ITCMD covers gifts as well as transfers on death, but a lifetime gift requires its own assessment. The relevant jurisdiction, taxable value, exemptions, filing obligations and payment deadlines must be checked for the proposed transfer. A rate or exemption used for an inheritance should not automatically be applied to a gift.

Giving assets away during life does not guarantee a lower overall tax cost. Before transferring property or money, review the tax consequences, ownership arrangements and effects on the family’s estate plan. For help planning a proposed lifetime transfer, see our lifetime estate planning service.

What if inherited assets will be sold or funds sent abroad?

Discuss the intended sale early so the estate documents, title records, valuation and tax filings support the transaction. Keeping property also creates an ongoing budget for maintenance, local charges and management.

For an international remittance, request the provider’s full cost, including the exchange rate, fees and applicable transaction taxes. Brazil’s Central Bank describes this combined measure as the Valor Efetivo Total (VET). Confirm the classification and any IOF treatment for the actual transaction instead of assuming one fixed charge. Central Bank — Total Effective Value of exchange transactions

How Oliveira Lawyers can help

We assist foreign heirs with Brazilian probate, the documents and information needed for tax review, and coordination with the relevant professionals and institutions. We can also assess whether a proposed distribution, valuation disagreement or planned sale needs separate legal work.

For an initial assessment, provide the date of death, the deceased’s last domicile, the locations and types of assets, the heirs’ locations, and any existing probate or tax notices. Indicate any deadline already received.

For advice on your circumstances, arrange a consultation with a senior bilingual attorney. For representation, request a professional-fee estimate identifying the work included and the taxes and third-party costs charged separately.

Frequently asked questions

Is there one inheritance-tax rate for all of Brazil?

No. Check the competent state or Federal District, applicable law, date of death, taxable share and any exemption. The national ceiling is not a universal rate.

Does living abroad exempt an heir from ITCMD?

Foreign residence does not itself create an exemption. The assets, connecting factors and applicable rules must be reviewed, including any cross-border issues.

Can I use the whole estate value in a calculator?

Not without checking what is actually transferred, each beneficiary’s taxable share, applicable brackets and deductions or exemptions. A simple whole-estate calculation can be misleading.

Must ITCMD always be paid before the probate deed is signed?

No blanket rule applies. CNJ Resolution 695/2026 changed the prior-payment condition for notarial deeds. Tax liability, state deadlines and later requirements still need separate review; the rule does not create a tax exemption.

Does inheritance tax cover every tax cost?

No. The estate’s income-tax position, a possible gain on transfer, a later sale and exchange transactions are separate matters. Professional fees and third-party expenses are also separate.

Will I owe U.S. estate tax simply because I live in the United States?

That fact alone does not determine the estate’s U.S. estate-tax exposure. The deceased’s citizenship or domicile, asset location and other estate facts matter. Your own receipt and foreign-asset reporting must be assessed separately.

Can the work be handled while I remain abroad?

Much of the legal and administrative work can often be handled through properly authorized representation. Document execution and court, notarial and bank requirements remain case-specific.

General information, not individual legal or tax advice. The applicable law, dates, jurisdictions and estate documents must be reviewed before a filing, payment or distribution decision is made.
