Legal Counsel for Luxury Real Estate Purchases in Brazil
Legal support for foreign buyers of mansions, apartments, coastal homes and other luxury properties in Brazil.
The price and appearance of a property do not establish whether its title, construction and intended use are in order. Our role is to assess the legal position, advise on the terms, and help carry the agreed transaction through to completion.
We assist private buyers and families purchasing for their own use or investment. Real estate funds and other institutional buyers can explore our institutional real estate services.
Legal support before you commit and through closing
Our work covers the legal aspects of acquiring and owning luxury properties in Brazil. The engagement should reflect the property, your intended use and the stage the transaction has reached.
Assess the property and the seller
We explain the regulatory framework for foreign ownership of property in Brazil and assist with due diligence, including title searches and the legal review of environmental issues. The review also considers the seller’s authority, relevant liabilities, and restrictions that could affect your plans.
See our Real Estate Due Diligence service for a focused investigation. Physical condition and market value require a different assessment; our appraisal and physical-investigation service addresses those questions.
Negotiate and complete the purchase
We draft and negotiate purchase and sale agreements and related contracts. The terms should address what is included, what must be resolved before completion, payment timing and delivery of possession. Our Full-Service Purchase Support covers assistance through the transaction within the agreed engagement.
Plan for ownership
We advise on property tax matters and other legal aspects of property ownership, offer advice on Brazilian inheritance laws and estate planning, and help with residency permits and immigration issues for foreign property owners. These workstreams should be scoped to your circumstances; they are not all automatically included in every purchase engagement.
We do not provide property management, rental operations or tenant management.

Buying a mansion or luxury house in Brazil
In Brazil, you find mansions by the beach, mansions deep in the city, mansions in the countryside, and mansions in the mountains. The setting matters because the land, buildings and proposed use can raise different legal questions.
A “mansion” description does not establish the property’s legal status. Before agreeing to the purchase, the review should address the actual parcel and improvements being sold.
Does the title cover what you have been shown?
A house may be marketed together with a garden, adjoining lot, guesthouse or private access. We review how those elements are reflected in the property records, who owns them, and whether access depends on rights over someone else’s land. A fence or sales description should not be treated as a substitute for that review.
Are the buildings and intended changes documented?
Extensions, pools, guesthouses and other improvements deserve attention alongside the main residence. We assess the relevant construction records, approvals and restrictions, including issues affecting a planned renovation. A technical inspection addresses physical condition; it does not establish that an alteration was authorized.
Can you use the house as intended?
For a home within a condominium, review the governing documents, charges, and restrictions relevant to renovations, rentals or other planned uses. For a coastal home, see our guide to coastal ownership and legal restrictions. For a country property, our Rural Land guide explains the separate acquisition issues that may apply.
What is included at completion?
Furniture, equipment, fixtures and promised repairs should be addressed expressly in the purchase terms. The agreement should also deal with occupants, possession and any conditions that must be satisfied before the balance is paid.
These questions guide the legal engagement. The property-buying guide explains the overall purchase sequence.
If you also need help finding a property
Property sourcing is available only if separately agreed. It is distinct from retaining us to advise on a property you have already selected.
Through one or more discovery Zoom meetings with our team, we gather the important requirements you are looking for. The ideal property profile is then used as a guide for a curated shortlist of properties for you to visit remotely or in person.
If you are looking for mansions in Brazil, we can help with a curated list of luxury mansions prepared according to your specific wishes. Our team can work across different real estate agencies so that the search is not limited to a single portfolio.
A shortlist is a starting point for investigation. It is not confirmation that a property has passed legal or physical review.
Other luxury properties we assist with
The types of properties we have traditionally assisted with in our high-net-worth client segment include the following. The legal review is tailored to the property and transaction.
Penthouses and condominium apartments
Review the unit and its associated rights, including terraces, parking and common areas, together with condominium obligations and relevant alterations. Explore our Penthouses page.
Beach houses and beachfront properties
A coastal address can raise questions about the rights being acquired, SPU records, beach access and building restrictions. Our Beachfront Properties guide explains those issues.
Private islands
The description “private island” needs careful review of the rights offered and the restrictions affecting access, occupation and development. See our Private Islands page.
Luxury estates
Luxury estates with more than a home include luxury country properties across Brazil. Some luxury estates come with additional houses, while others come with vineyards and other types of production. The rural-land acquisition rules may therefore be relevant alongside the review of title, buildings and intended use.
