Property Appraisals in Brazilian Probate: Tax Values, Fair Division and Buyouts

Property appraisals in Brazilian probate

A property may have several figures attached to it during probate: an old declared cost, a municipal tax reference, a tax assessment and an estimated sale price. Before agreeing to a number, identify what it measures, the date it relates to and the decision it will support.

For foreign heirs, a well-supported appraisal can help assess a proposed division, question an unsuitable valuation and negotiate a buyout. It does not automatically determine the tax payable or bind the other heirs or tax authority.

Four values that should not be treated as interchangeable

Value Its purpose What to ask
ITCMD tax base Calculating state inheritance tax on the transferred interest. Which state rules, valuation date and assessment method apply?
Federal income-tax transfer value Reporting the transfer from the estate and establishing relevant cost information. Will the choice create a gain for the estate, and what cost carries to the heir?
Value for partition or buyout Comparing allocations or negotiating the price of an heir’s interest. Are the parties using a consistent date, ownership fraction and set of assumptions?
Current sale appraisal Assessing the property’s likely market position for a proposed sale. Does the report reflect current condition, occupancy, title issues and relevant comparable evidence?

The same evidence may inform more than one decision, but the figures need not be identical. A difference should be understood and documented, not hidden.

Can heirs choose an old tax-return or IPTU value?

They should not choose whichever figure produces the lowest tax without checking the applicable rules. The national ITCMD framework uses market value, while state assessment procedures and the rules applicable to the particular succession must be considered. Complementary Law 227/2026 — ITCMD framework, arts. 146–159 and 182

São Paulo’s guidance, for example, describes the inheritance-tax value as market value and explains the role of IPTU or ITR references. Those references are not a general permission to ignore the property’s actual circumstances. São Paulo — property valuation, tax-return ruling 15476/2017

The tax authority may also question the reported value. STJ Tema 1371 addresses its power to determine a value through the procedure provided by article 148 of the National Tax Code when the legal conditions are met. That does not mean every official estimate is beyond challenge. STJ Tema 1371 — tax-authority valuation powers

Keep the original returns and tax records: they are important evidence even when they do not establish the final ITCMD base. For rates, payment timing and the overall budget, use our inheritance taxes and probate fees guide.

How the federal income-tax value differs

Receita Federal’s guidance allows inherited assets to be transferred, for federal income-tax purposes, using market value or the value recorded in the deceased’s asset declaration, within the applicable rules. An increase can generate a taxable gain for the estate, and the reported transfer value matters for the heir’s later gain calculation. Receita Federal — 2026 income-tax questions and answers

This is a separate decision from determining the ITCMD tax base. Ask the lawyer and accountant to reconcile the filings before the final estate declaration is submitted; do not treat the federal choice as an inheritance-tax discount.

Who establishes the value during probate?

The answer depends on the purpose and procedure. A value may be declared with supporting records, checked through an administrative assessment, examined by an appointed expert or supported by an independent appraisal commissioned by an interested party.

Do not assume every estate receives an on-site government inspection. Rio de Janeiro’s published guidance describes the use of municipal references and other market evidence for urban property, with administrative assessment where appropriate. Before commissioning a report, agree on its intended use. A sales opinion prepared for marketing may not satisfy the evidentiary requirements of a tax challenge or court dispute. Confirm the professional’s qualifications, methodology and responsibility for the report, as well as any requirements of the authority receiving it.

What a useful appraisal should explain

  • The property’s identity and registry reference, and the ownership interest being valued.
  • The purpose, effective valuation date and inspection date.
  • The documents examined and any missing or inconsistent information.
  • Physical condition, occupancy, access and other relevant limitations.
  • The comparable evidence and method used, including justified adjustments.
  • Whether the conclusion concerns the whole property, a fractional interest or another right.
  • Material assumptions, uncertainty and restrictions on the report’s use.

These are practical questions to agree with the professional, not a substitute for the technical standards or formal requirements applicable to a particular report. See our property appraisal service if a separate valuation assignment is needed.

When one heir wants the property and another wants cash

This is where an independent view can be particularly useful. An heir living locally may have better information about the property than a beneficiary abroad. Sharing the report and its assumptions gives everyone a clearer basis for negotiation.

Illustration: suppose the parties agree, for negotiation only, that a property is worth R$1,000,000 and one heir owns a 25% interest. The simple proportional reference is R$250,000. That is not automatically the buyout price or net payment: ownership rights, liabilities, occupancy, transaction costs and the terms of the agreement still need review.

A low figure used elsewhere does not automatically fix a future buyout price. Conversely, an optimistic asking price is not proof of realizable market value. Before signing a partition, release or transfer, understand which figure the agreement uses and whether a separate tax question arises from unequal allocations.

Where there is disagreement, concealed information or pressure to sign, see our inheritance disputes service.

What if the tax assessment appears too high?

Ask for the assessment and its reasoning. Compare the property description, area, ownership fraction, valuation date, condition and market evidence with the underlying records. A disagreement is stronger when it identifies a specific error or an unsupported assumption.

Use the applicable review procedure and observe its deadline. Paraná’s tax guidance, for example, permits a request for a contrary appraisal supported by a qualified professional’s report. Pernambuco has its own procedure and timing; there is no single nationwide objection timetable. Have counsel confirm whether a challenge affects payment or collection, whether another filing is needed, and the costs of pursuing it. Do not assume that ordering an appraisal or disputing a figure stops a deadline.

Coordinating a Brazilian appraisal with an overseas estate

Give the advisers in each country the same core information: the asset, ownership fraction, purpose of the valuation and relevant dates. Record the currency and any conversion method used. A translated report can help coordination, but it does not automatically satisfy another jurisdiction’s tax or evidentiary rules.

If the property will be retained or sold much later, distinguish the historical probate valuation from a new commercial appraisal. That avoids comparing figures produced for different dates and purposes as though one must be wrong.

How Oliveira Lawyers can help

We help foreign heirs understand the legal purpose of a valuation, identify the documents and professional input needed, and assess how the figure affects a proposed partition, tax position or dispute. Where a separate technical appraisal is required, its scope should be agreed with the qualified professional providing it.

For a review, gather the property registry record, available IPTU or rural-property records, any previous appraisal, relevant estate and tax documents, and any proposed buyout or assessment notice. Tell us whether the concern is tax, distribution, a family purchase or a future sale.

Arrange a consultation with a senior bilingual attorney to review the legal issues. Appraisal charges, tax work and representation should be identified separately in the proposed scope.

Frequently asked questions

Can we use the deceased’s income-tax value to reduce ITCMD?

Do not assume so. Federal income-tax transfer rules and state inheritance-tax valuation rules serve different purposes. Review both before choosing the values used in filings.

Is the IPTU value always the inheritance-tax value?

No. Its role depends on the applicable state rules and the facts. A municipal reference may be relevant without conclusively establishing the correct ITCMD base.

Will an appraisal automatically be accepted?

No. The report must fit its purpose and the relevant authority’s requirements. An authority or another heir may challenge its assumptions, evidence or conclusion.

Do we need an appraisal when one heir will buy out the others?

An independent appraisal can give the negotiations a common factual basis. It is particularly useful where interests conflict, access to the property differs, or the parties disagree about its condition or marketability.

Does a low probate value fix the price of a later sale?

Not automatically. A sale or buyout needs its own legal and commercial agreement. However, signed declarations and partition terms can affect evidence and bargaining positions, so review them before committing.

Can a foreign heir arrange a valuation from abroad?

Often, with an authorized representative and a suitably qualified local professional. Confirm whether inspection is possible, what documents are available and any limitations on the report.

General information, not a property valuation or individual legal or tax advice. A report’s suitability and the correct treatment depend on the property, documents, purpose and applicable rules.
