U.S.–Portugal tax planning: separate residence, reporting and relief
A Portuguese visa does not settle your tax position. Before relocating, review when tax residence begins, how each income stream is classified, and which returns or disclosures are required in each country.
Portuguese tax residence
Article 16 of the Portuguese income-tax code includes presence of more than 183 days in a relevant twelve-month period and a habitual-home test that can apply with fewer days. The test is not simply whether you own a home on December 31. Arrival, departure and split-year treatment require attention to the facts.
U.S. filing obligations continue
U.S. citizens generally remain subject to U.S. tax on worldwide income while abroad, with filing requirements depending on their circumstances. Portuguese tax residence can add another set of obligations. A visa, foreign tax payment or local exemption does not automatically remove U.S. reporting.
Foreign earned income exclusion versus foreign tax credit
The maximum foreign earned income exclusion for tax year 2026 is $132,900, subject to qualification and applicable proration. It concerns qualifying earned income, not a blanket exclusion for pensions, dividends or investment gains. A foreign tax home and the applicable residence or presence test matter.
A foreign tax credit is a different mechanism, generally limited by the type of foreign tax, income and U.S. limitation rules. Do not treat the exclusion as a credit for Portuguese tax paid, or assume the same income can receive overlapping relief without restrictions.
The treaty does not eliminate every overlap
The U.S.–Portugal income-tax treaty must be applied by income category and taxpayer status. Its saving-clause framework preserves substantial U.S. taxing rights over citizens, subject to exceptions. Pension, government-service, investment and employment income may need different analysis. Credits and treaty provisions can mitigate double taxation but do not guarantee that every amount is taxed only once.
NHR and IFICI are different regimes
The former Non-Habitual Resident regime was repealed from January 1, 2024, with protection for qualifying existing or transitional cases. It is not a general benefit attached to a new D7 or D8 visa.
IFICI, the scientific research and innovation incentive, has separate requirements for prior tax residence, eligible activities and registration. Qualifying Portuguese employment or self-employment income can receive a 20% rate under the regime; it is not a universal rate on all income. Foreign pensions are excluded from its general foreign-income exemption, and other exclusions and special rates can apply. Eligibility must be established rather than inferred from a job title or startup label.
Foreign accounts and asset disclosures
FBAR concerns qualifying foreign financial accounts whose aggregate value exceeds $10,000 at any time in the year, including certain financial-interest or signature-authority situations. It is not a test applied separately to each account. Form 8938 is a separate disclosure with thresholds that depend on filing status and residence; filing one does not necessarily replace the other.
A useful pre-move review
- Prepare an inventory of pensions, wages, businesses, trusts, investments and property.
- Map residence dates and days in each country.
- Review planned sales, distributions and retirement-account withdrawals before executing them.
- Assign responsibility for returns, account disclosures and supporting records.
- Check social-security coverage separately from income-tax treaty treatment.
This overview identifies coordination issues. The outcome depends on your income, status, dates and the rules applicable to the relevant tax year.
Discuss the legal and tax coordination your move requires. We will assess the facts and define the work included in the engagement.
