Why Clients Trust Oliveira Lawyers
- Judgment before you commit. We assess legal risks in the site, ownership, and proposed deal so you can seek protections, reconsider terms, or walk away.
- Agreements built around your investment. We address contributions, decision-making, deadlines, and exit terms with your partners and counterparties.
- A clear legal role within your team. Our attorneys work alongside your architects, engineers, and other specialists to connect legal questions with project decisions.
- Support when plans change. We advise on contract changes, delays, and disagreements, helping you understand your options before making the next commitment.
- A firm for the next stage. Property, company, tax, and estate matters can be addressed through separately agreed services as your investment develops.
Judgment clients have relied on. In our broader real estate work, one buyer describes being steered away from a bad deal and advised on risks and contract protections. Read our client reviews.

Brazil presents specific challenges to foreign investors. Opportunities may be located in areas where there is some level of uncertainty and constant change. Think of the Northeast of Brazil. New developments can be difficult to start, move forward, and complete successfully in such scenarios.
We have been there. We know the challenges and how to tackle them. Our role is to help you understand the legal risks, negotiate workable terms and make informed decisions as the project develops.
1 Legal support for your development
We offer the specialized knowledge, experience, and capacity to help owners and investors manage the legal aspects of every phase of the development process in Brazil.
We have experience with the legal issues arising during predevelopment, design, construction, and operations. Additionally, we work with specialist input for certain asset types, such as apartments and hotels. The professionals needed will depend on the project.
Because we understand the challenges developments face, you can rely on our expertise to guide the legal work with your best interests in mind, from project conception through closeout. The scope is agreed for your project; it can cover a specific decision or ongoing legal support.
Of the many types of investment in Brazil, real estate development can be rewarding. For investors in Brazil, it has the potential for good returns, but results depend on the site, costs, demand and execution. To assess legal risk in Brazil, organizations and public entities can hire our real estate development consulting in Brazil. Legal advice does not guarantee a profit or an approval.
2 What we can help you address
Real property development projects offer many opportunities but also present many challenges. We work with property and hotel owners to address the legal issues that affect their plans. Depending on the agreed scope, our work can include:
- The property and seller. Review ownership, debts, access rights and restrictions before you commit to the site. See our real estate due diligence service.
- Your agreement with partners. Address each party’s contribution, decision-making rights and responsibilities, including what happens if someone fails to perform or wants to leave.
- Approvals and registration. Review the legal requirements with your local technical team and identify issues to resolve with the authorities and property registry before work or sales begin. [1, 2]
- Contracts and changes during construction. Review payment stages, deadlines, changes in scope and remedies if work is delayed or disputed.
- Completion and the next use. Address the legal documents needed for handover, registration, sales or leases, according to the type of project.
For example, a project selling future apartment units has different registration requirements from an urban subdivision selling lots. We identify the applicable route before you take on commitments to buyers. The property registry’s requirements should be checked early; acceptance cannot be guaranteed. [1, 2]
3 How we work with your project team
The developers’ consultants act as the channel for communication with others in the development team. Our lawyers provide owners and investors with legal analyses, guidance, and clarification so they can make informed decisions. In some instances, the consultant analyses and negotiates potential terms to help an owner or investor choose an option that will meet their project’s needs.
Our role is legal advice and coordination within the agreed scope. Architects and engineers remain responsible for their designs, technical reports and construction work. Market studies, cost estimates and day-to-day site management require the appropriate specialists. Authorities decide whether to grant permits. [3, 4, 5]
Who does what
- You and your development team: choose the investment, budget and commercial objectives, and make project decisions.
- Our legal team: reviews legal risks and documents, advises on negotiations and coordinates legal questions with the other professionals.
- Your technical specialists: assess whether the design can be built, prepare the required technical work and manage the construction tasks assigned to them.
4 Start with your project and the decision ahead
Tell us where the property is, what you intend to build or renovate, the current stage and any deadline. If available, send the property record (matrÃcula), site details, existing plans and the proposed agreements. We will identify what information is needed to define the scope and quote for the legal work.
A consultation is a discussion of your situation. Document review and a written assessment require a separately agreed scope. If you need those services, identify the documents and deadline when contacting us.
For a neutral explanation of the process, read our Development and Construction in Brazil guide. It explains the main checks and approvals; this service page explains how we can assist with your project.
Frequently asked questions
Can you help before we buy the land
Yes. Developing a property project is a complex process. Early legal review can identify ownership, access, contract and approval issues before you commit. Your technical team should assess whether the proposed development is feasible. The findings may support renegotiating the deal or deciding not to proceed.
Do you advise only on residential projects
No. Our development work can address residential and commercial projects, including apartments and hotels. The legal scope and specialist input depend on the asset, location and intended use. Tell us about the project so we can assess the assistance required.
Can you take over a project that is already under way
We can assess the legal assistance needed at its current stage. Start by identifying the immediate concern, such as a contract change, approval issue or disagreement with a partner. Reviewing existing documents and deadlines helps define the next steps; it does not guarantee that earlier problems can be resolved.
Will your firm act as the developer or construction manager
Real estate developers are individuals and firms that control the activities affecting the construction or renovation of houses, business offices, retail centers, or other industrial buildings. This project could turn vacant or empty buildings into businesses and housing. Our firm’s role is legal support. We do not replace the developer, architect, engineer or construction manager.
